Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you,” “your,” or “Customer”) and Famz Tech (“Famz Tech,” “we,” “us,” or “our”), a [sole proprietorship / company — confirm legal structure], based in Pakistan, governing your access to and use of CastCadence (the “Service”), including the CastCadence website, dashboard, and any related APIs.

By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you're using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” refers to that entity.

If you do not agree to these Terms, do not use the Service.

1. What the Service Does

CastCadence is a multi-tenant platform that lets you manage social media publishing across multiple products/brands from a single workspace. In summary, the Service:

  • lets you organize multiple “products” (apps, games, or other brands) under one workspace, each with its own brand voice, visual identity, and connected social media accounts;
  • generates draft captions and content suggestions using a third-party AI provider based on images and context you provide (see Section 7 and our Privacy Policy);
  • schedules and publishes posts to social media accounts you connect, via a self-hosted instance of the open-source tool Postiz — either one we provision and manage for you (“platform-managed hosting”) or one you host yourself and connect to your account (“BYO hosting”); and
  • provides a calendar, dashboard, and analytics views over your posting activity.

We may add, change, or remove features over time. This is an early-stage product; some features described in our documentation or marketing may be under active development.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for business use — managing social media presence for products, brands, or organizations — not for personal, non-commercial use.

3. Accounts and Workspaces

  • You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • Workspaces support multiple members with different roles (owner, editor, viewer). The workspace owner is responsible for managing who has access and at what level.
  • You must provide accurate information when creating an account and keep it up to date.
  • Notify us promptly at [SUPPORT EMAIL] if you suspect unauthorized use of your account.

4. Subscription Plans and Billing

  • Paid plans are billed through Paddle (Paddle.com Market Ltd or its applicable affiliate), acting as the merchant of record for your purchase. Paddle handles payment processing, invoicing, and applicable sales tax/VAT — we never see or store your full payment card details.
  • Plans, pricing, and limits (number of products, connected accounts, monthly AI-generated posts, and similar) are described at checkout and in-app, and may change with notice. Continuing to use a paid plan after a price change takes effect means you accept the new price at your next renewal.
  • Trials: where offered, a trial converts automatically to a paid subscription at the end of the trial period unless you cancel before it ends.
  • Cancellation: you can cancel a subscription at any time from your workspace's billing settings or through Paddle's customer portal. Cancellation takes effect at the end of your current billing period; we don't provide prorated refunds for partial periods except where required by law or at our discretion.
  • Platform-managed hosting on cancellation: if your plan includes a platform-managed Postiz instance, we keep it running for 7 days after cancellation takes effect, so you have a window to export data or resubscribe. After that grace period, the instance and its data (draft posts, connected-account state stored on that instance) are permanently deleted. We are not able to recover it afterward.
  • Some plans referenced in our pricing may be offered on a limited or promotional basis and are not guaranteed to remain available.

5. Connected Social Media Accounts

  • You are solely responsible for complying with the terms of service, community guidelines, and policies of every social media platform (Instagram/Meta, X, TikTok, LinkedIn, YouTube, Facebook, and any others) you connect through the Service.
  • We are not responsible for, and have no control over, actions taken by those platforms against your accounts — including suspension, rate-limiting, API changes, or content removal — whether or not related to your use of the Service.
  • You represent that you have the necessary rights and authority to connect each social media account you add to the Service and to publish the content you publish through it.
  • Publishing reliability depends on the availability and API behavior of third-party platforms and, for platform-managed hosting, on the underlying infrastructure described in Section 6. We do not guarantee that every scheduled post will publish successfully or on time.

6. Platform-Managed and Self-Hosted (BYO) Hosting

  • Platform-managed hosting: if your plan includes this, we provision, host, and maintain a dedicated instance of Postiz on our infrastructure on your behalf. You do not have direct administrative access to the underlying server. We aim for reasonable uptime and security but do not guarantee uninterrupted availability.
  • BYO hosting: if you connect your own self-hosted Postiz instance, you are solely responsible for that instance's security, availability, updates, and compliance with any applicable laws. We are not responsible for data loss, downtime, or security incidents on infrastructure you host and control.
  • Regardless of hosting mode, credentials needed to connect to your Postiz instance are encrypted at rest and are never exposed to other customers or, in the case of platform-managed hosting, displayed back to you in plaintext in the dashboard.

7. AI-Generated Content

  • The Service uses a third-party AI provider (currently Anthropic) to generate draft captions and content suggestions based on images and context you provide.
  • AI-generated content is a starting draft, not a finished product. You are solely responsible for reviewing, editing, and approving any AI-generated content before it is published, including for accuracy, appropriateness, and compliance with applicable laws and platform policies. We do not review AI-generated drafts before you approve them, and we make no guarantee about their accuracy, originality, or fitness for any particular purpose.
  • You retain ownership of content you upload and of the final, approved posts you publish through the Service. You grant us a limited license to store, process, and transmit that content solely as needed to operate the Service (e.g., sending an image to our AI provider to generate a caption, or sending a post to a social platform's API to publish it).

8. Your Content and Acceptable Use

You agree not to use the Service to create, upload, or publish content that:

  • is illegal, defamatory, fraudulent, or infringes anyone's intellectual property or other rights;
  • violates the terms of service of any social media platform you connect;
  • contains malware or is intended to disrupt the Service or any third-party system;
  • is used to spam, harass, or deceive others.

We reserve the right to suspend or terminate accounts that violate this section, with or without notice, at our discretion.

9. Third-Party Services

The Service relies on and integrates with third-party providers, including Google Firebase/Google Cloud (authentication, database, file storage), Anthropic (AI content generation), Paddle (billing), Hostinger (infrastructure for platform-managed hosting), and the social media platforms you connect. Your use of the Service is also subject to those providers' own terms where applicable. We are not responsible for the acts, omissions, downtime, or policy changes of third-party providers.

10. Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practical. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

11. Termination

  • You may stop using the Service and cancel your subscription at any time (Section 4).
  • We may suspend or terminate your access to the Service if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a security or legal risk to us or others.
  • Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 7, 9, 12, 13, and 14) will survive.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or appropriate for your use case.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Famz Tech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim arose.

[This clause needs to be checked against Pakistani consumer-protection law and, if you'll have meaningful EU/UK/California customers, those jurisdictions' limits on liability disclaimers — some cannot be disclaimed as broadly as written here.]

14. Indemnification

You agree to indemnify and hold Famz Tech harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.

15. Governing Law and Disputes

These Terms are governed by the laws of Pakistan, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of [CITY, Pakistan — e.g., your city of registration/residence].

16. Changes to These Terms

We may update these Terms from time to time. We'll post the updated Terms with a new effective date, and for material changes we'll make reasonable efforts to notify active customers (e.g., by email or an in-app notice). Continued use of the Service after changes take effect means you accept the updated Terms.
